We may also collect additional information if you contact us for customer support. DEVICE INFORMATION

  • Purpose of collection: to load the Site accurately for you and to perform analytics on Site usage to optimise our Site.

  • Source of collection: collected automatically when you access our Site using cookies, log files, web beacons, tags or pixels.

  • Disclosure for a business purpose: shared with our processors Squarespace, Google Analytics and Meta.

  • Personal Information collected: version of web browser, IP address, time zone, cookie information, what pages you view, search terms, how you interact with the Site, and web pages you visited prior to coming to this Site.

CUSTOMER SUPPORT INFORMATION

  • Purpose of collection: to track, respond to your submissions and provide customer support

  • Disclosure for a business purpose: shared with our processor Squarespace.

  • Personal Information collected: name, email, phone number and customer request.

NEWSLETTER SUBSCRIBER INFORMATION

  • Purpose of collection: to manage newsletter subscriptions, communicate with you about Souled Out events, and send event updates, presales, promotions and other communications you have opted to receive.

  • Source of collection: collected directly from you when you subscribe to our newsletter or contact us, and may also be provided to us by Flicket when you purchase tickets to our events.

  • Disclosure for a business purpose: processed through Squarespace and Flicket, and may be stored using Google Workspace and Microsoft 365. Information may also be provided to an email marketing service provider if we use one to send communications on our behalf.

  • Personal Information collected: may include your name, email address, phone number, booking information and any other information you choose to provide.

Sharing Personal Information

We share your Personal Information with service providers to help us provide our services and fulfil our contracts with you, as described above. For example:

  • We share this information with Squarespace, our website analytics provider, to learn about site traffic and activity. Squarespace needs the data to run this website, and to protect and improve its platform and services. Squarespace analyses the data in a de-personalised form.

  • We share this information with Google Analytics to understand how visitors use our website and improve its performance.

  • We share this information with Meta, our social media analytics provider, to learn about social/site traffic and activity.

  • We may share your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful requests for information we receive, or to otherwise protect our rights.

  • We share this information with Flicket, our event ticketing provider. Information collected through Flicket is handled in accordance with Flicket's Privacy Policy. They have security measures in place to protect your Personal Information from misuse and loss and from unauthorised access, modification or disclosure.   • We may share or store newsletter subscriber and business contact information using third-party service providers including Google Workspace and Microsoft 365. These services are used to securely store, manage and access information required to operate our business. Access is limited to authorised persons who require the information for these purposes.

Behavioural Advertising

As described above, we use your Personal Information to provide you with targeted advertisements or marketing communications we believe may be of interest to you. For example:

Using Personal Information

We use your Personal Information to provide our services to you, which includes: offering services, products for sale, processing payments, shipping and fulfilment of your order, and keeping you up to date on new products, services, and offers.

Pursuant to the General Data Protection Regulation (“GDPR”), if you are a resident of the European Economic Area (“EEA”), we process your Personal Information under the following lawful bases:

  • The performance of the contract between you and the Site;

  • Compliance with our legal obligations;

When you purchase merchandise through our website, we use your Personal Information to process your order, arrange payment, shipping and fulfilment, communicate with you about your purchase, and provide customer support. This may include your name, billing address, shipping address, payment information, email address and phone number.

When you purchase tickets through Flicket, your booking and payment are processed by Flicket. Souled Out may receive information relating to your booking where required to administer the event, provide customer support or communicate important event information.

We share this information with Squarespace, our online store hosting provider, &/or Flicket, our event ticketing service so that they can provide website services to us.

As you go through checkout, this site may auto-complete your shipping and billing address by sharing what you type with the Google Places API and returning suggestions to you to improve your checkout experience.

Retention

We retain your Personal Information for as long as necessary to provide our products and services, fulfil merchandise orders, administer event bookings, maintain newsletter subscriptions, respond to enquiries, comply with our legal obligations, resolve disputes and enforce our agreements.

Order and booking information may be retained for accounting, taxation, warranty and record-keeping purposes. Newsletter subscriber information will generally be retained until you unsubscribe or request that it be deleted, unless we are required or permitted by law to retain it.

Automatic decision-making

If you are a resident of the EEA, you have the right to object to processing based solely on automated decision-making (which includes profiling), when that decision-making has a legal effect on you or otherwise significantly affects you.

We do not engage in fully automated decision-making that has a legal or otherwise significant effect using customer data.

Our processor Squarespace uses limited automated decision-making to prevent fraud that does not have a legal or otherwise significant effect on you.

Services that include elements of automated decision-making include:

  • Temporary blacklist of IP addresses associated with repeated failed transactions. This blacklist persists for a small number of hours.

  • Temporary blacklist of credit cards associated with blacklisted IP addresses. This blacklist persists for a small number of days.

Your rights

If you are a resident of the EEA, you have the right to access the Personal Information we hold about you, to port it to a new service, and to ask that your Personal Information be corrected, updated, or erased. Your Personal Information will be initially processed in Ireland and then will be transferred outside of Europe for storage and further processing, including to Canada and the United States.

If we engage an email marketing provider in the future, subscriber information may also be processed through that provider to send marketing communications on our behalf.

You can unsubscribe from marketing communications at any time by using the unsubscribe option included in our emails or by contacting us.

As noted above, if you would like to make a complaint, please contact us by e-mail or by mail using the details provided in our footer below.

If you are not satisfied with our response to your complaint, you have the right to lodge your complaint with the relevant data protection authority. You can contact your local data protection authority, or our supervisory authority.
